Purpose and Governing Principle

Phoenix is a political party with one protected founding objective: to secure, by lawful democratic means, permanent standing constitutional power held directly by the electorate through the House of the Electorate, including the proposed transfer of the constitutional function presently exercised through Royal Assent to Electoral Assent.

The objective is permanent; any entitlement of Phoenix to hold government office depends on elections, parliamentary confidence and applicable law.

Phoenix does not seek governmental power as an end in itself. It recognises, however, that lawful government must continue before a referendum, throughout any transition, and after the new constitutional arrangements become operational.

Phoenix may exercise ordinary governing powers while lawfully in office and must remain accountable for how it uses them.

1. The Single Protected Mandate

Phoenix will campaign for, seek electoral authority to pursue, and introduce the legislation necessary for a referendum on a proposed constitutional settlement.

That settlement would establish the House of the Electorate, protect the Declaration of Sovereignty and Bill of Rights through the approved constitutional framework, and create a practical means for the electorate to exercise Standing Power.

The Party will not treat an election victory as itself authorising the proposed constitutional changes.

It will seek the necessary legislative authority, public consent and lawful implementation.

The protected founding objective cannot be abandoned or redirected by Party officers or internal procedures contrary to the Party Constitution.

2. The Five Standing Powers

The proposed House of the Electorate would provide a continuing constitutional route for eligible members of the electorate to exercise five distinct powers, within the rights, procedures and safeguards of the adopted constitution:

• AUTHORISE — Give or withhold constitutional authorisation where the settlement requires the electorate’s approval.
• DIRECT — Issue lawful binding directions to public institutions on matters within the electorate’s constitutional competence.
• RESTRAIN — Limit or prevent the exercise of public power where the constitutional procedures permit.
• REVOKE — Withdraw a mandate, authorisation or decision through the applicable lawful process.
• AMEND — Alter eligible constitutional or public decisions under the applicable amendment procedures and protected-rights limits.

These powers do not permit violation of non-derogable rights or dispense with due process, independent judicial protection, transparent thresholds and lawful implementation.

Their precise legal scope must be defined by the proposed constitutional text and approved by the electorate.

3. From Royal Assent to Electoral Assent

Phoenix proposes transferring the constitutional assent function presently exercised through Royal Assent to a constitutionally defined form of Electoral Assent.

This is a distinct constitutional change, not a sixth Standing Power.

The legal mechanism, scope, commencement and safeguards must be specified in the referendum proposal and implementing legislation.

Until lawfully changed, existing constitutional arrangements remain in force.

4. The Referendum and Its Result

Phoenix will seek legislation setting out a clear referendum question, franchise, public-information requirements, legal consequences, implementation timetable and safeguards.

It will respect the result and will not implement a rejected constitutional settlement without a further lawful democratic mandate.

If the proposal is rejected, Phoenix may continue its lawful political and governing work while examining the reasons, consulting the public, and considering revisions.

Any later proposal would require its own lawful route and renewed public approval; repeated votes must not be used to disregard an electorate’s decision.

5. Government Before and During the Referendum

If elected to government, Phoenix will maintain essential services, public administration, fiscal responsibility, lawful security arrangements and existing legal obligations while pursuing its founding objective.

It may appoint or work with experienced MPs, ministers, civil servants, constitutional lawyers, economists and other specialists, including people previously associated with other parties.

Expertise does not confer authority to capture or redirect the founding objective.

Appointments and delegated responsibilities should be subject to transparent selection, conflict-of-interest disclosure, lawful accountability and the Party’s constitutional safeguards.

Elected representatives and public servants retain their independent legal duties.

6. The Constitutional Transition

A successful referendum would begin — not necessarily complete — the constitutional transition.

Phoenix proposes the following ordered safeguards, subject to the actual referendum legislation and adopted constitutional text:

1. Legally confirm the result and bring the approved implementation provisions into force according to their terms.
2. Maintain functioning government and essential public services; preserve existing powers until each is lawfully transferred or modified.
3. Constitute an independent transitional administration or oversight arrangement under clear legal authority, with appropriate safeguards against capture by outgoing officeholders.
4. Establish the House of the Electorate, the Guardian’s process-protection role, independent judicial safeguards, and the constitutionally required procedures.
5. Test and independently audit the Civic-Crowd-Device and any interim participation system for security, accessibility, integrity, accountability and practical reliability.
6. Commence binding Standing Power and Electoral Assent only when legally authorised and operationally ready; record and independently verify completion.

No prototype or interim digital platform becomes sovereign merely by being deployed.

Its decisions acquire binding force only where the applicable law expressly provides.

No constitutional vacuum is intended.

7. Accountability Upon Operational Completion

The founding objective is fulfilled only when the new Standing Power has been lawfully established and a practical means of exercising it has been demonstrated operational.

A referendum victory or an Act alone is not sufficient.

Phoenix does not automatically dissolve upon completion.

If lawfully entitled to remain in government, it continues to govern under the adopted constitution, subject to ordinary elections and the electorate’s new constitutional authority.

It must not use its organisation or resources to extinguish Standing Power or deprive future electorates of meaningful access to it.

8. Constitutional Institutions and Limits

• The People — The source of sovereign constitutional authority under the proposed settlement.
• The House of the Electorate — The means by which eligible electors exercise defined constitutional powers.
• The Constitutional Framework — The Declaration, Bill of Rights, constitutional rules, checks and protected safeguards.
• The Guardian — An independent protector of constitutional process and integrity, not a government or sovereign authority.
• Independent Courts — Protection of individual rights, lawful procedure and effective remedies.
• The Phoenix Party — A political vehicle, not the owner of sovereignty.
• The Phoenix Trust — Proposed public-benefit stewardship arrangements, distinct from political and sovereign authority.

9. Civic-Crowd-Device and Public Participation

The Civic-Crowd-Device is a proposed civic mechanism for informed participation, proposals, deliberation, decisions, scrutiny and audit.

Its software implementation is a tool, not a source of constitutional authority.

Any binding use requires lawful adoption, transparent procedures, secure and accessible operation, privacy safeguards, independent audit and review.

10. A Model for Every Nation

The Phoenix model is offered for voluntary consideration by peoples in other nations and territories.

No population is automatically represented, no local party is presumed to exist, and adoption must follow each community’s own lawful democratic processes.

Local organisations may choose their own names and constitutional routes, subject to any applicable naming or trademark arrangements.

The directory in Appendix A reproduces the original page’s proposed names for reference only.

Entries do not assert diplomatic recognition, territorial status, party registration, consent or organisational existence.

11. Public Commitment

Phoenix commits to lawful democratic change, a functioning government throughout the process, honest presentation of the referendum choice, respect for rejection, transparent constitutional implementation and permanent accountability once Standing Power is operational.

THE CROWD BECOMES THE CROWN — through lawful constitutional consent, not by force.
